Terms and Conditions


Introduction



ATTENTION: These Terms and Conditions constitute an agreement for consignment services, selling services, quoting services, buy-back service, authentication services, and buying services (the "Agreement") provided by LUXCELLENT (the "Company") to you or the person who visits and/or conduct business activities on LUXCELLENT website (the "Client"). Please read the terms and conditions contained below as they form part of a legally binding contract you will be entering into if you choose to conduct business activities, including but not limited to buying from, authenticating with, selling to, or consigning with the Company. 


The Company offers the Client a chance to purchase, sell, and consign authentic preowned luxury goods on The Company’s website (www.luxcellent.com) and have Client’s preowned luxury goods authenticated with LUXCELLENT website. By conduct of any of the business activities mentioned above, the Client accepts these Terms and Conditions.


About The Company

LUXCELLENT is operated by NYC Fashion Revival LLC. NYC Fashion Revival LLC is registered with the State of New York. The Company can be contacted by email at info@luxcellent.com.


1.The Agreement

The Agreement shall consist of only these Terms and Conditions. The Agreement shall only be entered into and come into effect once the the Client conduct business activities with The Company. The business activities include but not limited to browsing inventories of The Company’s website, contacting The Company in any forms, Requesting quotes from The Company, selling with or to the Company, consigning with or to the The Company, requesting authentication service from The Company, having The Company authenticate an item of the Client’s or an item that the Client will be or intend to pursue or purchase. The Client will pay for the requested total amount of the business activity agreed, tax, and shipping cost. The client understands that it will take at least 1-2 business day to process the order and the Client will not chargeback for the delay of shipment. When client receives the package, the client is responsible to check the package and the item inside of the package before signing the acceptance of the package. Client will be fully responsible for the damage of the item causing by the shipping carrier if the client didn’t inspect the package before signing. The client will have 24 hours starting from the time of delivery stated on the tracking number of the shipping carrier’s website to make a return request with our company. The date which we received the email of return request will be considered the official date of the return request file. The company tag must be intact when sending back the item. If the tag is removed, our company will not accept the return and will not refund the client. If the return request is filed with our company within 3 days of delivery, the client is responsible to ship the item back immediately. If The Company does not receive back the returned item, the Company will not refund the client. If the item is received, The Company will inspect and authenticate the condition and authenticity of the item to check if this is the same item that is being returned in the same condition. A refund will be issued after the returned item is fully inspected and authenticated and the refund will be deducted for a flat rate handling fee of $35. The return shipping cost will be buyer's responsibility. We recommend adding insurance and tracking service for the return shipping as it will be buyer's full responsibility if the package is lost or damage. For final sale items, no return will be accepted, regardless of reason. 



2. Services Offered

The Company offers the Client a chance to purchase, sell, and consign, sell back (buy-back program) authentic preowned luxury goods and to request authentication services on The Company’s website (www.luxcellent.com) and have Client’s preowned luxury goods authenticated with LUXCELLENT website. By conduct of any of the business activities mentioned above, the Client accepts these Terms and Conditions.

LUXCELLENT is also selling preowned luxury goods on www.tradesy.com as Luxcellent, www.etsy.com as Luxcellent Vintageluxe, and www.leprix.com as Luxcellent. Any business activities or services offered by the LUXCELLENT account on www.tradesy.com, www.etsy.com, and www.leprix.com, The Company will follow that website’s policies and terms and conditions. If Client places an order on www.tradesy.com, www.etsy.com, or www.leprix.com with The Company’s Tradesy account, Luxcellent, The Company's Etsy account, Luxcellent Vintageluxe, or The Company’s LePrix account, Luxcellent, the Client should seek assistance with LUXCELLENT’s Tradesy account team and Tradesy customer specialists, LUXCELLENT's Etsy account team and Etsy customer specialists, or LUXCELLENT's LePrix account team and LePrix customer specialists.

For selling an item to the Client, the Client agrees with this Terms and Conditions. Upon receiving a full payment from the Client, The Company will ship the sold item(s) within 2-3 business days (excluding weekends and Holidays). The Client has a 3-day return window for eligible domestic orders. Final sale items are not returnable and not refundable. A refund will be issued on eligible items after the returned items are fully inspected and authenticated and the refund will be deducted for a flat rate handling fee of $35. The return shipping cost will be buyer's responsibility. We recommend adding insurance and tracking service for the return shipping as it will be buyer's full responsibility if the package is lost or damage. The Client must inspect the package and has the security tag intact, and the item received unused and in the same condition upon requesting a return request. If an item is returned in a different condition, security tag is not intact, an item is returned with a different item than the item The Company sold, or the item the Client returns is a different item and is a counterfeit, the Client will be fully responsible for all the legal issues and no refund will be issued. The Client agrees not to chargeback if the return cannot be processed because of the Client's sole decision to remove the security tag, ships a different item or a counterfeit, or ships an item that has been used by the Client. 

For buy-back program, the Client agrees with this Terms and Conditions. The Client has 90 days from the day of purchase to sell the same item purchased from The Company to the Company. The buy-back price will be written on the buy-back agreement. Once the Client requests a buy-back via email to info@luxcellent.com, The Company will provide a buy-back agreement to the Client. Upon receiving a signed buy-back agreement through email, The Company will email the Client a free shipping label to ship the buy-back item. The buy-back item must be shipped within 5 business days from the day of The Company sends a free shipping label to the Client or the day the Client signs the buy-back agreement, whichever comes last. The Company will inspect and authenticate the item upon receiving the item. If the item contains more than normal signs of wear, the item is not the same item sold to the Client, or the item is a counterfeit (different item than the item The Company sold to the Client), The Client may receive a new quote for buy-back items with more than normal signs of wear or The Client will not receive payment if the item the Client ships to The Company is a different item or a counterfeit. The Client will be responsible for any legal actions against the Client as it is the Client's sole decision to ship a counterfeit to the Company or conceived the fact the Client ships a different item to The Company requesting for a buy-back than the item The Company sold to the Client. The Company reserves full rights to pursue any legal assistances for remedies from the Client. The Client will be fully responsible for the decisions and actions that the Client takes. Buy-back is not eligible on final sale items.

For consigning and selling to The Company, the Client agrees with this terms and conditions and the agreement that the Client signs with The Company. The consigned or sold item must be shipped within 5 business days from the day the Client signs the agreement or from the day The Company sends the free shipping label to the Client through email, whichever comes after. The agreement will be cancelled if the consigned or sold item(s) is/are not shipped within 5 business days. Any purchase on consigned items from the consignors or relatives/friends of consignors on our official website (luxcellent.com) is strictly prohibited.

If the item(s) you intend to consign or sell to The Company have any additional signs of wear not mentioned, please send an email to info@nycfashionrevival.com to provide with any additional pictures or details. Item(s) not accurately described will be refused and charged a $25 handling fee per order as per our terms. Item(s) not authentic will be refused and charged a $75 handling fee per order as per our terms.

For authentication service, please see the last part of this terms and conditions. The Client agrees to this terms and conditions along with the additional terms and conditions stated on the bottom of this term and conditions for the authentication service.

 

LUXCELLENT is operated by NYC Fashion Revival. NYC Fashion Revival is an independent company and is not an affiliate, agent, employee or legal representative of any websites or companies that NYC Fashion Revival does business with. The Company’s website and any information (including but not limited to the product information, hereinafter the "Information") are provided “as is" and to the extent permitted by law, without any kind of (express or implied) guarantee, commitment or liability. Except in case of willful misconduct, is not liable for any damages that are caused by or in connection with the use of the Information. In any case, NYC Fashion Revival LLC is not liable for and assumes no responsibility for any indirect, incidental or consequential damages that are caused by or in connection with the use of the Information.


3. Cost for Services Offered

The Client will pay for the requested total amount of the business activity agreed, tax, and shipping cost. An item that is eligible for refund, the refund will be issued after the returned item is fully inspected and authenticated and the refund will be deducted for a flat rate handling fee of $35. Final sale items are not returnable and not refundable. The return shipping cost will be buyer's responsibility. We recommend adding insurance and tracking service for the return shipping as it will be buyer's full responsibility if the item is lost or damage. If the Client returns a counterfeit or the returned item is used or The Company’s security tag is removed, no refund will be issued as it is the Client’s full responsibility to ensure the returned item to be the same item received, unused, and with The Company’s security tag intact for verification purpose. The Client who conducts a business activity on The Company’s website agrees not to chargeback The Company because Client does not properly follow the return policy listed on The Company’s website (www.luxcellent.com).




4. Client's Obligations & Acknowledgments

The Client will be obligated to pay for the requested total amount of the business activity agreed and conducted, tax, and shipping cost. This amount includes the item cost, tax, service fee, and/or shipping cost.

 

The Client will pay for the requested total amount of the business activity agreed, tax, and shipping cost. A refund will be issued after the eligible returned item is fully inspected and authenticated and the refund will be deducted for a flat rate handling fee of $35. The return shipping cost will be buyer's responsibility. We recommend adding insurance and tracking service for the return shipping as it will be buyer's full responsibility if the item is lost or damage.

The Client acknowledges that placing an order with our company the clients is entitled to pay the full amount of the purchase. 


5. Refunds

For buying from The Company’s website, once an eligible items have been accepted, inspected, and authenticated for return, the Company will issue refund back the final refund amount to the Client’s original payment method through Stripe or Paypal, depending on the Client’s choice during checkout. Please note that The Company will deduct the handling fee of $35 per item and this rule applies to both refund method (store credit/original payment method). The return period is 3 days starting the time of delivery stated on the tracking number of the shipping carrier's website. The Client agree with our return and refund policy when you agree with this Terms and Conditions. The $35 handling fee includes but not limited to a restocking fee and service fee. Once the Client requests for a return of an item, the Client agrees to still have The Company’s security tag intact on the returned item and the returned item is still unused and in the same condition. The Client acknowledges that no refund will be issued to the Client if the security tag is not intact, the returned item is not in the same condition, the item has been used, or the Client returns a counterfeit or a different item.

 

For selling and consigning with The Company, there will be no refund can be issued in any forms. All selling and consigning activities are non-refundable.

 

For free authenticating service with The Company, no refund or reimbursement will be issued as the service is offered free of charge. The Client understands that the authentication result is an opinion provided by Luxcellent and can have very limited margin of mistakes. The Company will not provide any form of reimbursement or refund by providing a result that the Client is not satisfied with, not aligned and the same result as the Client intends to have, the Client’s seller does not willing to provide additional photos, the Client does not willing to provide or unable to provide additional photos, no certificate can be issued, or the dispute or claim is lost due to the result of the authentication service or no certificate can be provided by The Company.

 

For buy-back program, the Client sells the purchased item back to The Company. The Company will pay the Client via Paypal, Chase Quickpay or The Company's check. No refund can be issued as this service is the Company pays the Client at the agreed buy-back price.

 

6. Company Liability

The Company shall not be liable for any deficiency including but not limited to any omissions, mistakes, erroneous attributions, authenticity issues in the consignment as a consequence of external circumstances, circumstances regarding the item(s) being authenticated, the Client failing to provide full and accurate information, and by any other factor that cannot be identified by a reasonable inspection of the photographs and other information received from the Client. 



7. Agreement Termination

The Agreement shall be terminated if the Company fail to respond on a quote within the time frame noted above or in any other way breech this Agreement. The Client, is entitled to terminate this Agreement with the Company in writing.



8. Indemnification

The Client Shall indemnify the Company and its authenticators, employees and officers against all liabilities and expenses incurred by them as a result of any breach of this agreement of arising from related claims by third parties in connection with the consignment service provided. 



Should the Client breach this Agreement by using the consignment quote for prohibited or illegal purposes, 1) the Agreement shall be terminated with immediate effect and the Client shall not be entitled to any refund, 2) the company's license to the consign, selling, authentication service, and quotes shall be revoked, and 3) the Client shall destroy the consignment quote, selling quotes, and/or the authentication result. There shall be no further liability of the Company to the Client from the date of termination of the Agreement.



9. Severance

In the event that any part of the Agreement should be held to be unenforceable for any reason, that term shall be deemed to be not part of the Agreement, the remaining portions of the Agreement shall remain in full force and effect.



10. Force Majeure

Neither party shall be liable in damages or have the right to terminate this agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including but not limited to acts of God (such as but not limited to fires, explosions, earthquakes, drought, title waves and floods); wars or hostilities, insurrections, revolutions, civil war, invasions, or acts of enemies (whether war be declared or not); riots, strikes, lock-outs or disorder; acts or threats of terrorism; and/or any other cause beyond the reasonable control of the party whose performance is affected (including mechanical, electronic, or communications failure).



11. Acceptable Use Policy

The Client is solely responsible for complying with all applicable laws in all of your actions related to your use of LUXCELLENT authentication services, regardless of the purpose of the use. 



12. Warranties


The authentication is provided to The Client on an “as is” basis without any warranties of any kind. The company and the staffs performing the authentication and inspection on the item being sold, to the fullest extent permitted by law, disclaim all warranties with regard to the authentication and inspection, including without limitation, the warranty of merchantability. The company and its staffs make no warranties about the accuracy, reliability, completeness, or timeliness of the authentication, inspection, and selling process. You also agree that your sole and exclusive remedy for our preparation of the authentication, inspection and selling process will be your contractual right to a return of the fees you paid to us for the services.

is a registered trademark of NYC Fashion Revival LLC (hereinafter "NYC"). LUXCELLENT is operated by NYC. Any kind of use of the aforesaid registered trademark of NYC should be subject to a written consent of NYC. NYC is an independent company and is not an affiliate, agent, employee or legal representative of any designer brand and/or brand name. This website and any information (including but not limited to the product information, hereinafter the "Information") are provided “as is" and to the extent permitted by law, without any kind of (express or implied) guarantee, commitment or liability. Except in case of willful misconduct, is not liable for any damages that are caused by or in connection with the use of the Information. In any case, NYC is not liable for and assumes no responsibility for any indirect, incidental or consequential damages that are caused by or in connection with the use of the Information.



14. Shipping

 

The Company offers free domestic shipping (within U.S. 50 States, not including Hawaii, Guam, or other U.S. territories) to all orders placed on LUXCELLENT. For international orders, the Client must contact LUXCELLENT via email at info@luxcellent.com before the Client places an order for international shipping. The shipping cost estimate will be given to the Client. Should the Client agrees with the international shipping cost, the agreed international shipping cost will be added to the cost of the order. The Client is entitled to pay for the total amount of the order, unless installments are agreed between the Client and LUXCELLENT in written agreement.

All orders will required 2-3 business processing days before the item is shipped. We will use USPS priority mails for all shipments. Direct Signature and Insurance will be added to the shipments. 

 

 

For consigning and selling to LUXCELLENT, The Company will offer a free shipping label to the Client to ship the consigned item(s) or sold item(s) to The Company. Should the Client wish to use the Client’s own shipping service, the shipping cost will be solely responsibility of the Client’s. The Client is obligated to ship the consigned or sold items to The Company within 5 business days from the day of receiving the free shipping label from The Company or the day that the Client signs the consignment or selling agreement contract with The Company.

 

For authentication service, all authentication results will be delivered to the Client’s account with LUXCELLENT. The Company will not send the authentication result to any third parties or business email addresses other than the Client’s email address or a personal email address. If The Company receives the email address that The Company considers the email address to be a business email address, The Company has rights to request the Client to re-submit another email address. The Client agrees to The Company’s rights to request for another email address for the authentication result to be sent to.

 

For buy-back program, the Client will be provided a free shipping label to ship the buy-back item. Should the Client wish to use the Client’s own shipping service, the shipping cost will be solely responsibility of the Client’s. The Client is obligated to ship the buy-back item to The Company within 5 business days from the day of receiving the free shipping label from The Company or the day that the Client signs the buy-back agreement contract with The Company.

 

Additional terms and conditions for authentication service.

1.The Agreement

The Agreement shall consist of only these Terms and Conditions. The Agreement shall only be entered into and come into effect once the Company has accepted to make an authentication of the item(s) and the Client has paid a flat rate of authentication service fee is $0 USD subject to the Company's right to withdraw its services in accordance with the terms.

 

2. Services Offered

The Company aims to provide the authentication of submitted items within 2-3 business days after the Client has submitted their request and/or after the Client has responded to the The Company's requests for additional information, if any, whichever occurs later. While the Company's goal is to respond within 2-3 business days during the Company’s business hours, such is not always possible to do so. If this period of 2-3 business days are exceeded, the Company shall not be obligated to issue a reimbursement. In the same respect, it is the client's responsibility to submit photographs in a timely manner. All photos and information needed for authentication must be submitted within 7 days from the date the order was placed.

 

3. Cost for Services Offered

The flat rate of authentication fee of $0 USD will be the cost for the Company’s authentication services. If the service fee is changed, the Client will seek an update price from the Company through email or the Company’s website for the latest service fee. The Company reserves the right to revise prices at any time.

 

4. Client's Obligations & Acknowledgments

The Client shall pay the authentication fee for the authentication to the Company. The Client shall provide clear and accurate photos and provide full and accurate information about the item(s) for more accurate authentication result.

The Client acknowledges that authentication of pre-owned luxury item(s) is based on the knowledge and opinions of the authenticators such result as to authenticity may differ.
Unless otherwise stated in writing, the authentication result will only consider as an opinion and the best knowledge of the authenticators that can be provided. The Client is welcome to seek a second opinion if the result of authentication is disagreed.

 

6. Client Grants Company Rights

Although the result of authentication email belongs to the Client, Client should not disclose the contents for any commercial or other uses other than acknowledgement on the item’s authenticity. Client can black-out any personal information but is not allowed to make any changes on the email of the result of authentication. 

 

7. Refunds

The Company will not provide any forms of refund or reimbursement for the authentication service as the service is free of charge.

The Company Will not reimbursement or partially reimburse authentication fee due to the fact that the outcome of the authentication result is not satisfied by the Client. The Company will not refund or partially refund the Client because the Client cannot provide additional required photos or information within seven (7) days of request. The authentication service request will be abandoned if the Client does not submitted all required information and photos 7 days after additional photos and information request is sent. 

 

8. Company Liability

The Company shall not be liable for any deficiency including but not limited to any omissions, mistakes, erroneous attributions, authenticity issues in the authentication as a consequence of external circumstances, circumstances regarding the item(s) being authenticated, the Client failing to provide full and accurate information, and by any other factor that cannot be identified by a reasonable inspection of the photographs and other information received from the Client. 

 

9.The Use of The Authentication Result

The Company will only provide an authentication result through emails and through Client's account. The Client shall not use the result of authentication from the Company, in any forms, to file a claim and/or open a case against the seller of the item(s) authenticated, the person(s) who provide, give, or sell the item(s) to the Client, and/or any organization(s) or any companies that will investigate or issue refund for the result of the item’s authenticity. The result of authenticity is only an acknowledgement to the Client for the authenticity of the item(s).

 

10. Agreement Termination

The Agreement shall be terminated if the Company fail to perform authentication within the time frame noted above or in any other way breech this Agreement. The Client, is entitled to terminate this Agreement with the Company in writing, and will be refunded the authentication service fee paid. The refund shall be credited to the Client by the same means through which the Client paid the Company.
